Terms of Service

By accessing or using EstatAI ("the Service", "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using EstatAI on behalf of a company or estate agency, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you ("you", "the Customer", "the Agency") and EstatAI ("we", "us", "our"), the provider of the estatai.co.uk platform.

EstatAI provides an AI-powered chat widget and lead generation platform designed for UK estate agencies. The Service includes:

• An embeddable JavaScript widget that installs on your estate agency website • An AI property consultant powered by large language models (GPT-4) • A dashboard for managing leads, widget configuration, and analytics • Lead capture, storage, and email notification functionality • Multilingual support for international buyer enquiries • SDLT calculation tools and UK property knowledge base

The Service is provided on a subscription basis with Free, Pro, and Premium tiers as described at estatai.co.uk/pricing.

Account creation To use EstatAI, you must register for an account providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials.

Eligibility You must be at least 18 years old and operating a legitimate estate agency or property business in the United Kingdom to use this Service.

Account security You are responsible for all activity that occurs under your account. Notify us immediately at hello@estatai.co.uk if you suspect unauthorised access.

Accurate information You agree to provide and maintain accurate account information. Accounts created with false information may be terminated without notice.

You agree to use EstatAI only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to collect data from individuals without appropriate legal basis under UK GDPR • Misrepresent the AI widget as a human agent to visitors • Use the platform to send spam, unsolicited communications, or engage in deceptive practices • Attempt to reverse engineer, copy, or create derivative works of our software • Use the Service to process data of individuals under 18 years old • Attempt to circumvent usage limits or access restrictions • Upload or transmit malicious code, viruses, or harmful content • Use the Service in any way that violates UK law or applicable regulations including the Consumer Protection from Unfair Trading Regulations 2008

We reserve the right to suspend or terminate accounts that violate these terms.

Important: AI accuracy EstatAI uses artificial intelligence to generate responses to property enquiries. While we train the AI on accurate UK property knowledge, AI systems can produce incorrect, outdated, or incomplete information.

SDLT calculations The SDLT calculator and any SDLT-related responses provided by the AI widget are for guidance purposes only. Individual stamp duty liability depends on personal circumstances, legal structures, applicable reliefs, and exemptions that the AI cannot fully assess. You must advise your clients to confirm their SDLT position with a qualified solicitor or HMRC-registered tax adviser before exchange of contracts.

Property advice The AI widget does not constitute legal, financial, mortgage, or property investment advice. EstatAI accepts no liability for decisions made by visitors or agencies based on AI-generated responses.

Your responsibility As the estate agency deploying the widget, you are responsible for: • Ensuring visitors understand they are interacting with an AI system • Having appropriate privacy notices on your website • Not relying solely on AI responses for legal or financial matters

Plans and pricing EstatAI is available on Free, Pro (£150/month), and Premium (£1,500 one-time + £50/month) plans. Current pricing is always available at estatai.co.uk/pricing.

Billing Pro and Premium subscriptions are billed monthly in advance. Payments are processed securely via Stripe.

Free plan limits The Free plan is limited to 50 AI conversations per month. When the limit is reached, the widget pauses until the next billing cycle.

Upgrades and downgrades Plan upgrades take effect immediately. Downgrades apply from the next billing cycle. No partial refunds are issued for downgrades within a billing period.

Cancellation You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months except where required by law.

Failed payments If a payment fails, we will attempt to retry. After 3 failed attempts, your account may be downgraded to the Free plan.

Your data Data collected through your EstatAI widget (visitor names, contact details, conversations) belongs to you. We process this data on your behalf as a data processor under UK GDPR.

Data processing By using EstatAI, you agree to our Data Processing Agreement, which forms part of these Terms. As a UK estate agency, you are the data controller for your visitors' data and must have a lawful basis for collecting it.

Your obligations You must: • Have a compliant Privacy Policy on your website that discloses AI chat usage • Have a lawful basis under UK GDPR for collecting visitor data via the widget • Honour visitor data subject rights requests relating to data collected via your widget

Our IP EstatAI, including its software, design, branding, AI models, training data, and documentation, is owned by us and protected by UK and international intellectual property laws. These Terms do not grant you any ownership rights.

Your content You retain ownership of any content or data you upload to EstatAI (such as property listings or custom knowledge base content). You grant us a limited licence to process this content solely to provide the Service.

Feedback If you provide suggestions or feedback about EstatAI, we may use this without restriction or compensation to you.

To the fullest extent permitted by UK law:

EstatAI's total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees paid by you to EstatAI in the 3 months preceding the claim.

We are not liable for: • Indirect, incidental, special, or consequential damages • Loss of profits, revenue, data, or business opportunities • Decisions made by you or your clients based on AI-generated content • Inaccuracies in SDLT calculations or property information provided by the AI • Service interruptions, downtime, or data loss beyond our reasonable control • Actions of third-party services (OpenAI, hosting providers, etc.)

Nothing in these Terms excludes liability for: • Death or personal injury caused by our negligence • Fraud or fraudulent misrepresentation • Any liability that cannot be excluded by UK law

By you You may terminate your account at any time by contacting hello@estatai.co.uk or using the cancellation option in your dashboard.

By us We may suspend or terminate your account immediately if: • You breach these Terms • Your use poses a risk to other users or the platform • We are required to do so by law • Your account is inactive for more than 12 months on the Free plan

Effect of termination Upon termination, your access to the Service ceases. Your data will be retained for 30 days then permanently deleted, unless you request immediate deletion or we are required to retain it by law.

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of EstatAI after the effective date constitutes acceptance.

If you do not agree to updated Terms, you may terminate your account before the effective date.

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of EstatAI shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating formal legal proceedings, you agree to first contact us at hello@estatai.co.uk to attempt to resolve the dispute informally within 30 days.
